For over 20 years, Trief & Olk has represented restaurants, both fine dining and casual establishments, in an array of matters, providing guidance in transactional work and acting as litigation counsel. The firm assists these companies in negotiating leases and drafting operating agreements and represents them in litigation that arises related to various issues, ranging from disputes with landlords to claims filed by employees for alleged unpaid minimum wage and/or overtime.

For example, Trief & Olk assisted a midtown restaurant in a years-long dispute with its landlord, whose principal was also a limited partner in the restaurant’s operating company. A range of disputes arose, relating to allegedly unpaid sums owed to the landlord, and then grew to involve the landlord’s default on its mortgage. Eventually, the parties litigated their various claims in an arbitration, in which the client was successful. Following this victory, Trief & Olk assisted the restaurant in negotiating to buy the property where the restaurant is located.

Trief & Olk has also represented a regional chain of breakfast and luncheon shops, negotiating leases on their behalf and defending them in a wage-hour lawsuit filed by a former employee. The firm also provided guidance to this client on wage-hour compliance matters to guard against any future claims for unpaid wages.
